You've been invited to the CueCaller private beta, run by Visually Impressive Productions ("VIP", "we", "us"). This agreement is in addition to our Terms of Use and Privacy Policy. By accepting it when you set your password, and by using the beta, you agree to everything below.
Treat anything about CueCaller that isn't already public on cuecaller.app as confidential. You may tell people you're testing a new timecode-driven cue-calling tool from VIP, but please don't share the specifics (screenshots, video, feature details, pricing, or how it works) publicly or with people who aren't in the program. This applies during the beta and until those details become public. Your access is for you (and, on a Tour team, the seats you've been given); don't share credentials or let others use your account.
If you disclose confidential beta information, we may immediately suspend or revoke your access and remove you from the program, and you may be denied access (including paid access) when CueCaller launches publicly. These steps are at VIP's sole discretion.
You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or architecture of CueCaller or any of its components. This applies to the application, its API, its audio/timecode engine, and any other part of the software or infrastructure you can access during the beta, whether by technical means or observation.
You may not copy, reproduce, clone, or create any derivative work of CueCaller, in whole or in part, for any purpose. This includes replicating its features, UI, workflows, or functionality in another product, service, or tool, whether commercial or not.
Any proprietary information you learn as a beta tester, including but not limited to how the product works, its feature set, its architecture, its roadmap, or its limitations, may not be used to design, build, or assist in building any product or service that competes with or duplicates the function of CueCaller. This restriction applies both during the beta and after your access ends, for as long as that information remains non-public.
CueCaller and all related technology, design, code, trade secrets, and know-how are and remain the exclusive property of Visually Impressive Productions. Beta access grants you a limited, non-transferable right to use the software for your own shows during the beta period. Nothing more. No license, ownership interest, or other IP right is granted to you by participating in the beta.
Your feedback is the whole point, and we want it. Any feedback, ideas, or suggestions you share may be used to build and improve CueCaller without restriction and without any obligation or compensation to you. You're not giving up rights to your own shows or cue sheets, only to the suggestions you choose to send us.
Beta features may change, break, or be removed, and access may be paused or ended as we develop the product. Beta access is complimentary at the tier we assign. CueCaller is an assistance tool, not a guarantee: live production is high-stakes, and software, hardware, audio, and networks can fail. Always keep a manual backup procedure and never rely on CueCaller as your only means of calling a cue. The full warranty and liability terms are in our Terms of Use.
By checking the agreement box when you set your password, and by using the beta, you accept this Beta Program Agreement together with our Terms of Use and Privacy Policy.
